By accessing, browsing, or using the Bear Den Initiative website located at beardeninitiative.org (the "Site"), the Sleuth Command portal, or any services, features, or content offered by Bear Den Initiative (collectively, the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms").
If you do not agree to these Terms, you must not access or use the Service. Your continued use of the Service after any modifications to these Terms constitutes your acceptance of the revised Terms.
Bear Den Initiative ("BDI," "we," "us," or "our") operates a community portal — the Sleuth Command — designed to support members of the KarebearXP streaming community (the "Sleuth"). The Service includes:
The Service is provided for personal, non-commercial community use. BDI reserves the right to modify, suspend, or discontinue any part of the Service at any time without notice.
You must be at least 13 years of age to use the Service. If you are between 13 and 18 years of age, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
By using the Service, you represent and warrant that you meet these eligibility requirements and that your use of the Service does not violate any applicable law or regulation.
The Service uses third-party OAuth authentication (Twitch and/or Discord) to verify your identity. You do not create a separate password-based account with BDI directly. By authenticating via Twitch or Discord, you also agree to those platforms' respective terms of service and privacy policies.

Moderators may also choose to link their own Kick, Google/YouTube, and Velora accounts for use in Den's Echoes. Linking an account is optional and can be undone at any time.
BDI reserves the right to suspend or terminate access for any account that violates these Terms or that we determine, in our sole discretion, poses a risk to the community.
You agree not to use the Service to:
Violation of these conduct standards may result in immediate removal from the Service and, where applicable, reporting to relevant platform administrators or law enforcement.
The Service integrates with and links to third-party platforms including Twitch, Discord, YouTube, Kick, Velora, TikTok, Lumia Stream, and Google Services. These integrations are provided for convenience and community functionality. BDI is not responsible for the content, policies, or practices of any third-party platform.
When you authenticate via Twitch or Discord, data from those platforms (such as your username, avatar, subscription status, and follower data) is accessed via their authorized APIs in accordance with their developer terms. You may revoke BDI's access at any time through the respective platform's account settings.
Your use of third-party services is governed by their respective terms of service and privacy policies, which we encourage you to review.
"User Content" means any content you submit, upload, or display through the Service, including your Sleuth handle, cabin customizations, profile settings, and any communications submitted via scheduling or application forms.
By submitting User Content, you grant Bear Den Initiative a non-exclusive, royalty-free, worldwide license to use, store, display, and distribute that content solely for the purpose of operating and improving the Service.
You represent that you own or have the necessary rights to submit User Content, and that your User Content does not violate the rights of any third party.
BDI reserves the right to remove any User Content that violates these Terms or that we determine, in our sole discretion, is inappropriate for the community.
All content, branding, graphics, logos, portal code, design elements, and materials on the Site — including the Bear Den Initiative name, Sleuth Command branding, the cabin painter feature, and all associated imagery — are owned by or licensed to Bear Den Initiative and are protected by applicable intellectual property laws.
You may not reproduce, distribute, modify, publicly display, or create derivative works from any BDI-owned content without prior written permission.
The KarebearXP name and associated stream branding remain the intellectual property of their respective owner.
The Sleuth Reinvestment Fund displayed on the portal tracks community donations intended to fund gear upgrades for the Sleuth. Please note:

Bear Den Initiative uses the TikTok API ("TikTok Developer Services") to display live stream status, live stream links, and related public content for the KarebearXP TikTok account (@karebearxp).
By using the portions of our Service that involve TikTok data, you acknowledge:
If TikTok modifies or revokes our API access, certain portal features may become unavailable. BDI bears no liability for any service disruption resulting from changes to TikTok's API or developer program.
Bear Den Initiative uses YouTube API Services to show when KarebearXP is live on YouTube, to show her YouTube live chat to her moderators, and to let moderators who link their Google account moderate that chat.
By using the YouTube features of the Service, you agree to be bound by the YouTube Terms of Service. Google's handling of your information is covered by the Google Privacy Policy, and BDI's handling of YouTube data is described in Section 15 of our Privacy Policy.
If YouTube changes, limits, or ends our API access, YouTube features may stop working. BDI is not liable for any disruption caused by changes to YouTube API Services.
Den's Echoes is available only to moderators approved by KarebearXP or BDI. If you use it, you agree that:
BDI may remove access to Den's Echoes at any time. You can unlink any connected account from Den's Echoes whenever you like.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. BDI DISCLAIMS ALL WARRANTIES INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. Community stats, achievement data, and fund totals are provided for informational purposes and may not always reflect real-time accuracy.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BEAR DEN INITIATIVE AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE SERVICE.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO ACCESS THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.
BDI reserves the right to suspend or permanently terminate your access to the Service at any time, with or without cause or notice, including for violations of these Terms, disruptive behavior within the community, or any reason we deem necessary to protect the safety and integrity of the Sleuth.
You may discontinue use of the Service at any time by revoking BDI's OAuth access through your Twitch or Discord account settings (and, for moderators, through Kick, Velora, or the Google security settings page). Upon termination, your profile data may be retained for a reasonable period as described in our Privacy Policy, after which it will be deleted.
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict of law provisions.
Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Pennsylvania. You waive any objection to such jurisdiction or venue.
We reserve the right to modify these Terms at any time. When we make material changes, we will update the effective date at the top of this page. Your continued use of the Service following any changes constitutes your acceptance of the updated Terms.
We encourage you to review these Terms periodically. For significant changes, we may also post an announcement in the portal or the BDI Discord server.
